Buhari, APC close defence at presidential tribunal

After calling seven witnesses, President Muhammadu Buhari and the All Progressives Congress (APC) closed their defence in the petition filed by the Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, yesterday.

Accordingly, the Justice Mohammed Garba-led tribunal August 21 for final arguments in the petition.

PDP and Atiku, who are challenging the outcome of the February 23 election won by President Buhari had closed their case on July 19, after calling 62 witnesses and tendering over 40,000 documents.

The first respondent, Independent National Electoral Commission (INECl, had informed the court that it would not call any witness, saying it would rely on responses of all the petitioners’ witnesses that were cross-examined.

Buhari commenced his defence on Tuesday after the Independent National Electoral Commission (INEC) had closed its case on Monday without calling any witness.

However, when the matter came up on for continuation, yesterday, lead counsel for Buhari, Chief Wole Olanipekun (SAN), announced that his team was satisfied with the seven witnesses they had led.

He said his client, having considered the totality of evidence before the tribunal, decided that there was no need to further waste the time of the court.

“My lords, we have studied the hardware, software and even hardcopy of the petition and evidence presented by the petitioners, vis-à-vis the issues, which in our humble view, are in contention and evidence. That is, issues that have been ventilated in this court and not outside. We have come to the decision that it is time that we restrict the legal dwell to the four corners of this Court.

“We are very satisfied with the evidence we have led and will be closing the case of the 2nd Respondent within the four walls of this court, where we were trained to operate. I had indeed assured your lordships two days ago that when we start, there would be no going back”, Olanipekun stated.

Responding, counsel for the APC, Lateef Fagbemi (SAN), equally told the tribunal that his team also found it unnecessary to call any witness.

“In the normal course of events, it is the turn of the third respondent to open its defence. I have ruminated over whether to talk now or later. I am eternally grateful to the petitioners for doing such a great work by providing us the ammunition for defence. Having considered all the evidence, we believe there is no point in indulging in an over-kill exercise. In the circumstance, we will be closing our case. We, the third respondent, announce that we are satisfied with the cross-examination and evidence proffered.

“In the circumstance, I, as leader of this team, announce the closure of the case of the third respondent.”

Fagbemi however, urged the tribunal to grant the respondents till Monday to procure some documents they would need to file their final written addresses.

Olanikpekun equally expressed the need for time to look at some of the evidence already laid before the tribunal.

Lead counsel for the petitioners, Dr. Livy Uzoukwu, SAN, said his clients had predicted the move by both the APC and Buhari, saying all they did in the case was “to save face.”

He pleaded that since there are three respondents to the petition, the petitioners should be granted seven days to file their final written address.

The tribunal ordered that the petitioners should upon receipt of the addresses take seven days afterwards to file their own. Justice Garba said the respondent were at liberty to within two days after the petitioners had filed their process, reply on points of law.

He ordered that filing and exchange of processes by the parties should be concluded before August 16, even as he adjourned further proceedings till August 21 for adoption of all the final written addresses.

The tribunal shall thereafter, fix a date for judgment.

‘Don’t hold on to government money’

The Chairman of the House of Representatives Committee on Finance, James Faleke, has warned revenue generating agencies to refrain from holding on to money collected on behalf of the Federal Government.

Faleke noted that prompt remittance would be enforced to ensure effective funding and implementation of the appropriation.

In a statement in Lagos on Wednesday, Faleke blamed the non-implementation of projects proposed in the yearly appropriation on paucity of funds, saying his committee would monitor agencies.

He said, “The country is faced with inability to fund her budget due to shortfall in revenue. This committee will ensure that all the revenue generating agencies remit what is due to the Federation account.”

The Lagos (Ikeja Federal Constituency) lawmaker said he would work for the provision of critical infrastructure such as roads, electricity, schools, hospitals, as well as an enabling environment for business to thrive.

The committee chair lauded the introduction of the Treasury Single Account, saying it had reduced corruption.

He assured Nigerians that his committee would discharge its assigned mandate appropriately.

“I want to thank the Speaker and the entire leadership of the House for considering me worthy to chair the Committee on Finance. I promise that we will not let the country down,” Faleke said.

Soldiers allegedly gang-rape AAUA student at checkpoint

Some soldiers have allegedly raped a female student (name withheld) of the Adekunle Ajasin University, Akungba Akoko.

The incident allegedly happened on Wednesday evening at the military checkpoint at Ikare Akoko in Akoko North-East Local Government Area of Ondo State.

According to a source, the soldiers, who were attached to the Ikare Akoko checkpoint, allegedly raped the lady, a 300-level student at AAUA, while she was returning from the campus.

The source, who identified one of the soldiers, alleged that the soldiers took turns to sexually assault the victim.

He said one of the soldiers at the checkpoint allegedly ordered the victim to get down from a vehicle she and others were travelling in, and took her into a cubicle at the back of the checkpoint where the soldiers allegedly forcefully had sex with her.

A student of the institution who witnessed the incident but who did not want her name in print for fear of intimidation and harassment confirmed the incident.

She said, “We went to Ikare Police Station to report the incident and then rushed her to Ondo State Specialist Hospital, Ikare-Akoko, for examination and treatment.

“As I’m talking to you, she is at the hospital and doctors confirmed that she was raped.”

The eyewitness said it was not the first time such a thing would be happening at the military checkpoint in the town.

A Police source at the Ikare Police Station, who confirmed that the incident was reported at the station around 7:15 p.m. on Wednesday, said the Police had stepped into the matter.

The source confirmed that the name of a Lance Corporal was mentioned in the statement written by the complainant.

“The matter was reported here, but I won’t say more on it. When we complete our investigation, it would be sent to the headquarters in Akure,” he stated.

When contacted, the Police Public Relations Officer of the Ondo State Command, Mr. Femi Joseph, however, said he was not aware of the incident.

The management of the AAUA said it had commenced investigation into the matter and had constituted a panel of inquiry to examine the allegation.

The Head of Media and Protocol Unit of the university, Mr. Victor Akinpelumi, confirmed that the management of the institution was aware of the incident and had initiated an investigation into it.

WAEC to acquire magic scanners for document authentication

The West African Examinations Council says it is set to acquire three technological devices known as Magic Scanners PS 1000 for authentication of documents and responses.

The council’s Head of National Office, Mr Olu Adenipekun, made the disclosure on Thursday in Lagos State at a news conference to announce WAEC’s hosting of the 37th annual conference of the Association for Educational Assessment in Africa.

The annual conference will take place in Abuja from August 5 to August 9, with the theme: “Innovations in Educational Assessment”, according to Adenipekun.

He said that participants at the conference would come from all parts of the world.

According to Adenipekun, a major issue to be discussed at the conference would be innovation.

He noted that technology had turned the world into a global village, adding that WAEC would need to rely on innovation to continue to deliver on its mandate.

“This conference is all about coming together to encourage relevant assessment activities among members. Participants will want to see how they are responding to new challenges, financing, as well as the development of human capital.

“This will enable us to share knowledge on issues of evaluation and assessment, and sponsor international participation in the field of educational testing and assessment within member-countries.

“One thing that will be coming on board is how we can apply technology to improve our service delivery.

“The place of technology in the education sector is one thing that will take the centre stage by looking at how innovations and technologies can be deployed in the conduct of public examinations in Nigeria.

“In this regard, therefore, WAEC has concluded plans to acquire three Magic Scanner PS 1000 from a company in the UK which has shown interest to come and unveil this technology at the conference.

“This Magic Scanner will be used to authenticate documents and responses before they are taken to the clouds, ‘’ he said.

Adenipekun added that the council was looking to acquiring a tracking device that would be used to dispatch examination materials.

He said that the acquisition would be from another UK company that would also participate at the conference.

He said that representatives of about 25 African countries, including South Sudan, and over 350 others from Europe and America, would participate at the conference.

The HNO added that heads of tertiary institutions and other administrative officers would be expected to attend the conference.

The WAEC boss gave the assurance that adequate security had been put in place for the event.

“We want to assure those visiting that they are safe, as adequate arrangements have been made.

“We also want to seize the opportunity to showcase our rich culture and heritage as well as our hospitality in order to project Nigeria in a good light, especially to those visiting for the first time,’’ he said.

Thousands rally in Sudan against student killings

Thousands of Sudanese demonstrators rallied in the capital and other cities Thursday after protest leaders called for a “million-strong” march to condemn the killings of four schoolchildren.

Tragedy struck Al-Obeid on Monday when four high school students and two other protesters were shot dead at a rally against growing bread and fuel shortages in the city in central Sudan.

A top general, Jamal Omar, accused members of the feared paramilitary Rapid Support Forces (RSF) of opening fire on what was a students’ rally in Al-Obeid.

On Thursday, demonstrators marched in several areas of Khartoum after their leaders called for a mass rally to “seek justice” for those killed in Al-Obeid and other protest-linked violence.

“Where is the investigation committee?” chanted protesters as they marched in the Burri and Bahri districts, sites of regular protests since they first erupted in December against the regime of now-ousted president Omar al-Bashir.

Many carried Sudanese flags and photographs of some of those people killed in the months-long protest campaign.

Protesters also rallied in Al-Obeid, the Red Sea coastal city of Port Sudan, in White Nile state and in the central city of Madani, witnesses said.

Omar, a member of Sudan’s ruling military council which has taken over from Bashir, accused elements of the feared RSF of opening fire at the Al-Obeid rally.

The rally was initially stopped with batons by a group of RSF forces guarding a nearby bank, the general told reporters during a visit to the city late Wednesday.

“This action led to a reaction from some students who threw stones at the forces,” Omar said.

“This made some members of the force act in their individual capacity to open fire on protesters. We have identified those who fired live ammunition that led to the killing of the six,” he said.
